The NDP, The Quebec Question and 50% + 1

Much has been made of Jack Layton's "controversial" comments on a possible Quebec sovereignty referendum.

The fact is that it is a very rational and defensible position. Based on the closest precedent, the entry of Newfoundland into Confederation, Quebec has followed the same rules, keep on holding referendums hoping to get the result you want with 50% + 1 required for passage. After all, otherwise we have a minority deciding Quebec's constitutional status.

That position, however, has it's problems. Other constitutional precedents require greater than 50% + 1 to make constitutional changes. As well, if support is that close the results of a referendum can vary from day to day.

That is why I tend to support requiring something like 60% support for such changes in constitutional arrangements, to ensure that the new constitutional arrangement will have continuing support. However that position also has it's flaws because in the case of, for example, a clear and continuous 55% support for sovereignty, the minority that opposes the change in status would effectively decide the fate of Quebec.

That is why the real focus needs to be on maintaining strong support for federalism in Quebec, support that has just recently been very effectively expressed by the people of Quebec in choosing a federalist social democratic party over a sovereignist one. We need to work on building and strengthening a strong federalist consensus in Quebec.

This will not be done by "giving Quebec whatever it wants" but by giving Quebec respect and building a strong Canadian community. This starts with recognizing Quebec's nationhood and it's right to decide it's own fate. Can we have a country within a country. It seems to work well enough for England, Scotland and Wales, within a unitary state. When have you ever heard Scots refer to themselves as "United Kingdomers" but their loyalty to both their country of Scotland and their nation state of the United Kingdom does not seem to be in conflict.

We have the best opportunity ever to set aside separatism in Quebec and build a strong Canada that includes Quebec. Quebec has spoken in the election and chosen federalism. All we have to do is work with the Quebecois to build a strong united Canada with them.

In the United Kingdom Peaceful Protest Is Now Terrorism

Here’s one example of the intimidation of peaceful protest by the young that is happening all over Britain. Nicky Wishart is a 12-year-old self-described “maths geek” who lives in the heart of David Cameron’s constituency. He was gutted when he found out his youth club was being shut down as part of the cuts: there’s nowhere else to hang out in his village. He was particularly outraged when he discovered online that Cameron had said, before the election, that he was “committed” to keeping youth clubs open. So he did the right thing. He organized a totally peaceful protest on Facebook outside Cameron’s constituency surgery. A few days later, the police arrived at his school. They hauled him out of his lessons, told him the anti-terrorism squad was monitoring him and threatened him with arrest.

The message to Nicky Wishart and his generation is very clear: don’t get any fancy ideas about being an engaged citizen. Go back to your X-Box and X-Factor, and leave politics to the millionaires in charge.

Generation Inspired - Let Capitalism Fail



No comment required.

However, I cannot help but comment as I watch this and think about how we are supposed to react to the international response to the economic crisis and the measures being taken to save capitalism from collapse. What is happening is exactly what Karl Marx predicted except that he did nor foresee the use of a form of socialism for the rich to save capitalism. As governments world wide use austerity measures against workers to bail out the banks and corporations that have exploited them for years we are supposed to sit back and take it because there is no alternative.

But, there is an alternative. Let history happen. Let capitalism fail and build a new society from the ashes of the old.

Municipal Elections Suck

So why do municipal elections suck.

Because the way the system works now all too often the least preferred candidate wins rather than the most preferred candidate.

This results from the fact that there are often a large number of candidates, many of whom may share a similar philosophy and similar policies and who appeal to the same group of voters. For simplicity sake lets divide the candidates (and voters) into alphas and betas, for want of better terms.

Various scenarios can come into play here but for demonstration purposes lets look at a simple one. Let us say there are three alpha candidates that share 60% of the vote roughly and one beta candidate with 40% of the vote. Let us assume, reasonably, that the beta candidate is the last choice of almost all of the alpha voters. And let us assume, also reasonably, that while all the alpha voters may have individual preferences all the alpha candidates are acceptable to almost all of the alpha voters.

Under our present electoral system the beta candidate, the last choice of the majority of voters and the one acceptable to only a minority of voters would get elected. Similar situations can happen with different numbers of candidates and different breakdowns with either beta or alpha candidates benefiting from the flaw in the system.

Another effect of this of course is that people realize this is happening and "strategic voting" comes into play and voters attempt to avoid this by voting for their second or third choices instead of their first, depending on who the media says has the best chance of winning. Such a situation deprives voters of the ability to vote for their first choice and gives the media an inordinate (and undemocratic) amount of power in choosing who gets elected.

There is an alternative - system that allows voters to vote for their first choice amongst acceptable candidates and not vote for unacceptable candidates. Instead of voting for one candidate you would rank the candidates in order of preference, ranking as many candidates as you wish and avoiding ranking unacceptable candidates if you do not wish to. The votes would be tabulated electronically dropping the bottom candidates from the list and redistributing their votes to the voters next choice until a candidate receives over 50% of the vote.

Under this system the least preferred candidate would never be elected and the elected candidate would always be acceptable to the majority of voters.

This would allow voters to vote for their first choice knowing that if their first choice was not amongst the top vote recipients their vote would be transferred to their second choice and not become a de facto vote for the candidate they least liked. Strategic voting would be eliminated and all candidates would know how much real first ballot support they had and candidates would not be penalized because the media tells everyone they do not have a chance.

This type of system, of course, would not just work in municipal elections. Indeed, this is the type of system that the United Kingdom is going to hold a referendum on.

Using such a system in Ontario municipal elections would be an excellent place for us to start. While it is likely too late to introduce in this years election it may very well not be too late to add a question to the ballot in the November election to find out what voters think of the system.

There are some serious allegations buried in the nastiness on this page, if you look that far. However their credibility is extremely tainted by the nastiness they are buried in. This might have been fun to create but how effective it is is really questionable.

Legalizing Spousal Rape In Afghanistan – Not So Foreign to Canadian Law

As the CBC reports, Afghanistan's proposed law to legalize spousal rape, or to put it in other terms “make it illegal for women to refuse their husbands sex”, has rightly been widely condemned.

However, we would be wrong to characterize this as some sort of Islamic barbarism foreign to western civilizations.

Indeed, as the Globe and Mail reports, the same provision existed in Canadian law up until 1983.

Indeed, the concept has had a long history in the jurisprudence of the United Kingdom, Commonwealth countries, Canada and the United States, as the following articles record:
