Now Comes The Necessary Part Ontario Edition

Nevertheless, and irrregardless of and notwithstanding that federal-provincial jurisdiction exists the actions that are necessary for the next Ontario government to take are the same as those the newly elected federal government needs to take. It’s the same electorate and the same Canadians and the same solutions that are required.

To that end I am simply annotating my recent blog post to establish its relevancy to the Ontario election.


Now Comes The Necessary Part

We can argue all we want over whether the election was necessary but what is definitely necessary is the government tackling the pressing issues of the day, issues that have been pressing for decades and in some cases since before Confederation.

Indigenous Reconciliation

This is clearly an area where the primary jurisdiction is federal but that does not change the fact that both the federal and provincial Crowns have been responsible for the encroachment on First Nation's Lands and the denial of their inherent rights. The Ontario government has a clear role to play in reconciliation, along with the people of the province.

The longest standing issue in Canadian political history is the plight (struggled over what language to use here) of the original inhabitants of North America and the effects of European “discovery” and colonization.

[Side note: I often think the dictionary should define “discover” as “stumble upon”.]

The recent discovery of 150 (latest count Canada wide 6,000 and growing) unmarked graves at an Indian Residential School in British Columbia has focused Canadians thoughts on the treatment of North America’s indigenous peoples from unfairly negotiated treaties to the lack of clean drinking water on reserves.

People are finally realizing that it was not simply a problem of a few bad people abusing a few children in a few schools but a systemic policy of cultural genocide (“take the Indian out of the Indian”) seen as, in the words of the Indian Affairs Department, the “final solution to the Indian problem”. The facilities included such high levels of neglect and abuse that the likelihood of dying in an Indian Residential School was slightly higher than the likelihood of dying as a soldier in World War II.

Of course the term school for these facilities is inappropriate. Schools have graduates, not survivors.

It is no wonder there are problems in indigenous communities when the destruction of indigenous families and culture was government policy for so long.

Governments have committed themselves to reconciliation but what will that be. From my euro-centric viewpoint I would see it as a new social contract between Indigenous Peoples and the rest of Canada, something that will have to be achieved by consensus. But it will be up to Indigenous communities to decide when reconciliation has been achieved as they are the only ones capable of judging that.

[Another side note: Until then the flags should stay down.]

Health Care

Health care is an area where the primary responsibility is provincial. Indeed the national health care program we have now was pioneered by Saskatchewan under provincial jurisdiction. There is nothing beyond political will preventing the new Ontario government from implementing the measures cited below as an example to the rest of Canada.

Public health care, or Medicare as we Canadians call it, was first implemented in Saskatchewan in the form of hospital coverage in 1947, followed by full health care coverage following the 1960 provincial election. Federally the Medical Care Act was passed in 1968, followed by the Canada Health Act in 1984 which affirmed and clarified five founding principles: public administration, comprehensiveness, universality, portability and accessibility.

However in the over 50 years since then the system has stagnated, indeed it has gone backwards with the federal level of funding decreasing over time. We need to finish building the system and we cannot wait another 50 years to do it incrementally. The government must act now to extend the system to include:

- at least 50% federal funding

- a family doctor for every Canadian

- full mental health care, including psychology services where medically necessary

- full long term care for those requiring residential care

- full prescription drug coverage

- full eye care coverage

- full dental care coverage

- full physiotherapy coverage where medically required

Climate Change

Combating climate change will require a myriad of policy decisions that involve both federal and provincial governments, The new Ontario government must move to address this in the areas under it's jurisdiction.

The first warnings of climate change and it’s effects were noted over 50 years ago and the warnings have become more dire year after year with governments responding with lots of promises but little real action. The irony of all this delay is that the longer we wait to act, the more drastic actions we have to take to respond to this crisis. Those against taking drastic measures should have been calling for us to take action sooner rather than arguing against taking action at all.

The idea of starting new fossil fuel projects at a time when we need to start phasing out fossil fuels is simply ridiculous yet it is treated as a serious option in industry and government circles. How drastic to we want the measures to have to be when we finally realize we have to take action before it is too late.

From an economic point of view there are a tremendous number of opportunities available in the renewable energy sector. Call it whatever you want but the concept of a Green New Deal may be the economic and environmental salvation of our future.

Inequality & Under-taxation

Inequality requires tackling the problem at both ends. At the bottom we need to bring workers income and wealth up. As most workers and jobs fall under provincial jurisdiction it is clearly the Ontario government’s responsibility to increase minimum wages and employment standards, the most important being to make it easier for all workers, especially those in the so-called “gig economy”, to unionize. Also it is well within the province’s jurisdiction to establish a guaranteed basic income to eliminate poverty.

At the other end of the scale, the overpaid and overwealthed, the province has all of the tax measures available to them that the federal government has to redistribute income. To the extent that the income tax system is harmonized with the federal system the province always has the option to do as Quebec has and separate it’s income tax system from the federal one.

Ever since the creation of capitalism there has been inequality because the system is designed to create and reward inequality.

However I have to say that during my lifetime (since the 1950s) it has become noticeably worse. One factor is that the wealthy capitalists have moved the means of production to low wage countries so that their portion of the rewards of labour has increased, while the jobs left behind in North America are lower wage jobs.

They have invented a whole new sector of the economy based on piece-work to avoid paying the existing minimum wages or providing employee benefits and they give it a snazzy sounding name, the gig economy, to try to convince people they are freeing them from wage drudgery and letting them be their own boss when in reality the corporation has more control over them than if they were unionized wage workers.

At the same time the taxation of corporations and the wealthy has declined, partly in response to corporate blackmail threatening to take more jobs elsewhere if they are forced to pay fair levels of taxation.

It is also because wealth equals political power and excessive wealth equals excessive political power and that power is used to enact polices that favour the wealthy.

Governments need to enact policies that are actually designed to serve working people and dedicated to their well being, policies that will counter inequality and under-taxation.

Let us start with decent minimum wages and labour laws designed to encourage and assist workers in organizing unions. Minimum wages should not be designed to keep workers just above the poverty line but designed to provide workers with a middle class income. Our economy has the money to do that it just requires a little redistribution from those with excessive wealth to the people that actually produce that wealth.

We also need a guaranteed basic income for those that for whatever reason are unable to be employed at any particular time.

We can increase employment by redistributing money from the private sector to the public sector via a tax on excessive income and wealth to provide jobs building public infrastructure and affordable housing for everyone.

As for taxation, we can start by raising the level at which people start paying income taxes and increase the amount of tax paid in the higher marginal tax brackets. We also need dedicated taxes on excessive levels of income and wealth. I would tax away all excessive income (above $1,000,000 annually and all excessive wealth (above $100,000,000) but I do not expect any government to go near that. However that leaves a huge amount of room for a wealth tax that will have little practical impact on the standard of living of the excessively wealth while providing great benefit to the common good.

This is not in any way proposed as a punishment but just a means for them to create a better country/world with no impact on their personal well being.

Electoral Reform

Ontario and the federal government currently share the same Single Member Plurality (SMP) electoral system. Both need to change. There is no reason Ontario cannot act first and set an example for the federal government and the other provinces.

Winston Churchill is often quoted as saying “democracy is the worst form of Government except for all those other forms”.

Ever since democracy (“rule of the people” in Greek) was invented by they Greeks we have been looking for ways to make it less worst.

[Yet another side note: My Eurocentric education tells me democracy was invented by the Greeks but I would not be surprised if forms of democracy were being used in non-European cultures before then.]

The key to any democracy is the electoral system, how the people actually select the people to represent them in government.

The system we use now is Single Member Plurality (SMP), more often referred to as First Past The Post (FPTP), an objectively silly name. In Single Member Plurality systems the country (or other jurisdiction) is broken into constituencies and each constituency chooses a representative to send to the legislature. Whichever candidate receives the most votes becomes that representative. We use the term plurality because the candidate does not have to receive a majority of votes cast, just more than any other candidate.

The main benefit of SMP is that voters elect local representatives.

The main drawback is the elected candidates could possibly be the last choice of more voters than they are the first choice. Also theoretically a party could elect 100% of MPs with less than 50% of the total votes, though in practice a typical result may be more like 60% of MPs with 40% of the votes.

There are two main proposals to replace this system: Ranked Ballots (preferred by the Liberals but not in their platform) and Mixed Member Proportional (proposed by the NDP in their platform).

Ranked Ballots solves one of the problems of SMP in that it avoids the last choice of a majority of voters being elected as MPs or forming a government. It however will likely create an even less representative House of Commons based on voters first choice party preferences.

Under Mixed Member Proportional (MMP) a majority of Members of Parliament are elected in the same manner as SMP to represent defined constituencies. Then an additional number are selected from party lists in order to balance the percentage of MPs from each party with the percentage of total votes received by each party (often referred to as the “popular vote”) to form a House of Commons representative of the views of the total population. Under MMP there is usually a threshold of percentage of total vote required to be allotted seats, often 5%, to avoid radical fringe groups having representation. However if that threshold is met a party receives representation. But is not representation of all voters what democracy is about.

One of the main criticisms of MMP is that it is unlikely to provide one party majority governments (unless a majority of voters support one party). But is that not what democracy is supposed to provide, a legislature that reflects the will of the people. Would we not be better off if parties learned to work together for the common good rather than simply engaging in political posturing. By reducing the power of a single party in government you reduce the power of a single person (the majority party leader), and perhaps get back to actual representative government rather than the trend of effectively electing (even if indirectly) a dictator to rule over Parliament.

Changing our electoral system to a more democratic one, MMP, is the most important thing the government can do.

Conclusion

These are not the only issues of importance but ones that have not been properly addressed over decades and more. We need the political will to address them all now without the excuse that the solutions need to be implemented incrementally.

Both the federal and the new Ontario government need to act urgently on these priorities.

Intuitive Lessons from The Pandemic – A Fantasy

This post is not based on comprehensive research or particular expertise on my part. Rather it is more what we would have called “common sense” before Mike Harris completely destroyed the meaning of the phrase.

We start off with the most obvious. We need a public health care system that is not overloaded to begin with. We can solve two problems here, provide pandemic readiness and provide timely life enhancing health care. We currently provide timely care for life threatening situations like cancer, heart surgery and emergency trauma but have created an artificial class of so called “elective surgery” we consider to be of lesser importance. This includes things like hip and knee surgery and replacements and many other types of health care that are necessary to allow people to live fulfilling lives. Health care is much more than preventing premature deaths. If we provided the necessary resources to provide all necessary health care without unreasonable wait times we would have the capacity to deal with a pandemic without putting peoples lives at risk.

Equally obvious is the need to bring long term care into the public health care system. Before the pandemic the horror stories of private long term care were well known even if the body counts were not as inexcusable as they became with the pandemic meeting the profit motive.

And still looking at the health care system, why did doctors offices shut down or become virtual during the pandemic when they should have been part of the response to it. Family physicians provide the first source of diagnosis for many serious illnesses like heart disease and cancer where early detection can be a matter of life and death. The system may respond quickly when these diseases are diagnosed but it does not respond at all when they are not detected. And why was the network of family physicians not used for pandemic testing and vaccinations.

And what of government policies. The big thing we got right was vaccines. In comparison to some jurisdictions to the south of us, all jurisdictions understand the importance and effectiveness of vaccines. The federal government did an admirable job of making vaccines available to the provinces and the provinces did a decent job in administering them. The main things Ontario could have done better was utilizing doctors offices and the school system to more efficiently get vaccines to the public.

As to the timely and appropriate response to the threat that is where we could have done better. We knew it was coming but we didn’t know what it would be like so it was a learning process. There is lots to criticize in hindsight but more importantly is learning going forward.

The biggest lesson was that internationally jurisdictions that put public health first and took strong, even drastic, measures quickly were able to get out of it faster than those that took half measures being more concerned with protecting the so-called economy than the public’s health. Having a provincial leader that considered himself a “businessman first” and by implication a Premier second did not help. We are still stumbling through in Ontario.

What is saving us is our sense of community. This works on two levels. On the personal level, it means in our personal behaviour, such as distancing, mask wearing and getting vaccinated, we base our decisions not just on what will keep us safe but also on what will keep our neighbours safe. This has made the big difference on how Canada has fared, compared to the United States, who arguably had better resources available to fight the pandemic.

The other level is the collective level, our collective actions taken together through our governments.

Here we are talking about three levels of government, federal, provincial and local, sometimes with differing philosophies and priorities. We really need to find a way to make federalism work better in these sorts of, not just national but international emergencies, climate change being another example.

If the pandemic has shown us anything is that individual action cannot replace collective action, and some things are just done better by acting collectively rather than acting individually. This is where we need to do better, particularly by strengthening our health care system and providing social supports. We are not financially prepared for the next pandemic because the political parties in power have chosen to go down the populist road of under-taxation thinking that would buy them votes. This is perhaps the most disastrous public policy position of the last half century.

Fortunately, because of that trend, there is substantial room to increase taxes to fill the void, particularly on that portion of the population that are excessively wealthy and under-taxed. This is a group in society that actually stands to gain more from collective spending by government than they can from individual spending by themselves. There is only so much you can spend on a wealthy lifestyle and the benefits of a better society far outweigh the benefits of people who have everything buying more everything for themselves.

We can be better prepared next time, and there will be a next time, but only if we choose to.

And the fantasy part – the belief that those in power will actually choose to learn these lessons and implement the necessary measures.

The future of Laurentian University is in the hands of a flawed process and an anti-education government

When Laurentian University was founded it was not to create a profit making enterprise but to create an educational institution to serve the north, one that went on to include an important partnership with the Franco-Ontarian and Indigenous communities.

Using a mechanism (Companies' Creditors Arrangement Act) designed to ensure profit making enterprises can continue to earn a profit as a means to solve it’s financial problems is doomed to failure from the start. I fear greatly that this great institution will be damaged beyond repair by this process as our anti-education provincial government and “businessman first” Premier stand idly by and watch.

We now have a process based on making cuts to ensure profitability and prioritizing revenue earning programs rather than than prioritizing the programs most important to the institution and the community.

The first thing that should have been done to address Laurentian University's future was to identify the most important programs, particularly those that can only be provided by Laurentian University or provided better there than elsewhere.

At this time of reconciliation there is one program at Laurentian University that stands out from all others and that is the Indigenous Studies Program, and supports for Indigenous students and ties to the Indigenous community. This is a program that is historically important not just to Laurentian University but to all of North America.

A plan to save Laurentian University must have its indigenous component at the forefront. The Indigenous Studies Program should not only be preserved with no cutbacks but expanded. Retaining a few courses and slapping them together into a token program is the worst thing that could be done and would be about as disrespectful as could possibly be to the Indigenous community.

That, of course, should not be the only priority. Near the top should be programs and research in the social sciences that focus on Northern Ontario in particular and northern communities in general.

In the sciences and engineering sectors, programs, courses, and research dealing with the ecology and environment of the north should prioritized along with programs and research related to the mining industry.

As well, programs in the health sciences and professional schools designed to meet the particular needs of Northern Ontario, such as social work, nursing and midwifery, also need to be protected.

The traditional arts programs and courses may be easier replaced by programs at other institutions but courses relating to northern history and culture, including francophone culture and history, should be protected.

As an Honours Bachelor of Arts (Political Science) graduate (May 1973) I would be remiss if I did not mention the Political Science program, which in my time provided me with a unique education in both applied and theoretical politics with a particular Northern Ontario focus.

Only after it has been determined what needs to be saved to protect the unique Northern Ontario mandate of the University should an analysis of what should be done to solve the university’s financial problems be undertaken. Gutting the university is not the answer. Strategic investments are more likely to be succesful.

To be done properly this process would require extensive community consultation, impossible with the flawed process that has been chosen that puts the process in the hands of bankers and accountants rather than educators and community representatives.

With the ultimate decision making power in the hands of a provincial government that is anti-education and anti-community I fear for the future of Laurentian University.

Ontario’s COVID-19 Disaster in Five Words

The Ontario government would like to blame the behaviour of Ontario’s citizens for this disaster implying somehow we are so much worse than the citizens of other countries, and even other provinces, that are at the end of this crisis as we enter the worst of it. The fact is other jurisdictions acted quicker and stronger and got through the worst quicker because they put the health of their citizens first.

Ontario has from the start tried to get by with half measures because the government’s priority was protecting business interests, the sacred economy. Now the government is flailing about trying to appear to be doing something while failing to implement many of the measures recommended by public health experts, and implementing others that will have little impact beyond punishing the citizens of the province for the government’s inaction and ineptitude.

Indeed the priority of Premier Doug Ford is not protecting the health of Ontario. His priority is not even governing the province of Ontario. His priority is reflected in the five words he uttered so proudly “I’m a businessman first”.

COVID-19 and Education in Ontario – An Imaginative Approach

Let me start by saying that I understand that hindsight is a big advantage and some may ask why didn't I think of this sooner and my response is that thinking about education in Ontario is not my full time job but it is for Ontario's Ministry of Education.

While it may be seem late now It seems to me that at some point the Education Ministry should have realized that too much time has passed to do justice to the curriculum for this year and the best solution might be to just start over next fall and use the rest of the school year creatively for students.

The result would be Ontario students requiring thirteen tears to complete their elementary and secondary education instead of twelve. This is something that millions of Ontario students, including myself did before 2003 and we turned out just fine.

Instead of trying to finish the curriculum using what can only be described as rushed into service experimental online methods, why not do something more creative with the online teaching and what little in classroom teaching time may be left in this school year.

Why not let teachers go “off-curriculum” or perhaps more accurately described as parallel to curriculum, by putting a local focus on their teaching. Teach local history, and in particular the history of the indigenous peoples in their area. Teach about the history of their communities and local industries and businesses, community groups, etc. Focus science and geography on the local ecosystem and the scientific principles behind local industries. Go a bit farther afield and teach some of the history of the local immigrant communities, particularly refugees. The opportunities for creative teachers are endless.

Each community and neighbourhood should have it's own focus which is why letting individual teachers go “off-curriculum” is the best way to achieve this.

Use this as an opportunity for these students to finish elementary and secondary school with a greater education than otherwise, rather than a lessor one.

Backroad Mapbooks Ontario GPS Map Version 5 Now Available With My Greenbelt Trail Maps Included

Backroad Mapbooks now has Version 5 of their Ontario GPS Map available. Actually it has been available since the fall but I only checked for updates at the start of the Spring biking season.

I am very impressed with the Backroad Mapbooks product, as I state in my review on my “Richard's GPS Trail Maps” website.

Version 5 includes all of the Greenbelt Trail Maps on my ”Richard's GPS Trail Maps” web site. Indeed it includes all my trail maps on the site except for the Stittsville “Jackson Trails” Trail System, which I expect to be included with the next update. I provide them with the tracks for all of my maps and soon will be adding a map of the “Scissons Road Quadrant of the Old Quarry Trail System to the website.

Indeed the Backroom Mapbooks GPS map is the easiest way to use my maps on a Garmin GPS as they are already on the background map and do not have to be loaded. However if you do not have a Garmin GPS, or the Backroad mapbooks GPS map you can download the tracks from my “Richard's GPS Trail Maps” website.

Unlike Garmin, which is primarily a technology company, that purchases it's maps from third parties, likely at the lowest price possible, Backroad Mapbooks is a mapping company that had it start with the goal of mapping all the backroads of Canada and has now extended that goal to include trail systems

Thoughts on Taking The Lane

As I am not an expert on cycling safety this post is not intended to be advice on how to safely take the lane but only my thoughts on the subject.

While I am not one of those “vehicular cyclists”, that oppose cycling infrastructure because they think that the best place for all cyclists is on the roads competing for space with car drivers, I do believe that cyclists have a right to be able to ride on the roads safely. I also agree with the City of Ottawa when they tell cyclists “never compromise your safety for the convenience of a motorist”.

One of the most important ways that cyclists can ensure their safety on the roads is by taking the lane (riding in the middle of the lane of traffic) when appropriate and necessary.

The Legal Right to Take The Lane

The legal right to do this is provided in the Ontario Highway Traffic Act, R.S.O. 1990, c. H.8.

Slow vehicles to travel on right side

147. (1) Any vehicle travelling upon a roadway at less than the normal speed of traffic at that time and place shall, where practicable, be driven in the right-hand lane then available for traffic or as close as practicable to the right hand curb or edge of the roadway. R.S.O. 1990, c. H.8, s. 147 (1).

The key phrase here is “where practicable” and while that is not defined in the Act it seems reasonable to assume that in legislation dealing with highway safety that “where practicable” would include where safe and that a right to take the lane would therefore exist where that is the only safe option.

Indeed the City of Ottawa, Ottawa Police Service and the Ministry of Transportation clearly agree with that interpretation.

The section of the City of Ottawa website: Cycling and the law states:

Rules of the road

Cyclists are required to ride as close as possible to the right curb of the roadway, except when:

●Travelling at the normal speed of traffic

●Avoiding hazardous conditions

●The roadway is too narrow for a bicycle and a motor vehicle to travel safely side-by-side

●Tiding alongside another cyclist in a manner that does not impede the normal movement of traffic

●Preparing to make a left turn, passing another vehicle, or using a one-way street (in which case riding alongside the left curb is permitted)

The Share The Road section of the Ottawa Police Service website states:

Riding Tips for the Road

1. Ride predictably and defensively.

2. Ride in a straight line at least one metre from the curb or parked cars.

3. You may occupy any part of a lane when your safety warrants it. Never compromise your safety just for the convenience of others.

And the Ontario Ministry of Transportation's Ontario's Guide to Safe Cycling states:

Taking a lane

In urban areas where a curb lane is too narrow to share safely with a motorist, it is legal to take the whole lane by riding in the centre of it. On high-speed roads, it is not safe to take the whole lane. To move left in a lane, should check, signal, left and shoulder check again then move to the centre of the lane when it is safe to do so.

It also states:

Accordingly, cyclists should ride one meter from the curb or close to the right hand edge of the road when there is no curb, unless they are turning left, going faster than other vehicles or if the lane is too narrow to share.

As well it states:

Around parked vehicles

Ride in a straight line at least one metre away from parked vehicles. Keep to this line even if the vehicles are far apart to avoid continuous swerving.

Cycle in a straight line past parked vehicles; do not swerve towards the curb when parked vehicles are far apart

When riding around parked vehicles, cyclists should watch for motorists and passengers who may open their car door into the cyclists' path.

And the Canadian Cycling Association CAN-BIKE Program: safety tips states:

Going…going, gone! When one lane disappears, use the other one

Highway Traffic Acts across Canada tell all vehicle users to occupy any part of a lane when safety warrants it. Bikes are vehicles too. In the event of parked vehicles, construction, snow banks, etc. If the lane is obstructed and there is not enough room to share the lane while passing the obstruction, take the whole lane to prevent vehicles from passing too close.

1. Look well ahead when you ride and pre-plan your position on the road.

2. Shoulder check first to make sure there is room and then signal before taking the lane.

3. Shoulder check again to make sure the drivers behind you respect your intention.

4. Take the centre of the lane and ride in a straight line.

5. Repeat 2 & 3 and return to the right most side of the lane when the obstruction is passed.

So we have established not only the legal right to take the lane but the fact that the authorities recommend it in appropriate situations.

Taking The Lane Safely

That of course does not change the fact that taking the lane can be intimidating, and even hazardous if not done carefully. After all, it is not wise to just pull out in front of bigger heavier vehicles going faster than you.

The first rule, and this applies to all cycling in traffic, is to be constantly aware of the traffic around you. No riding with headphones on or texting while cycling. Your life may depend on how aware you are.

You should also be aware of the road and driving conditions so that you can be prepared to ease into taking the lane safely, as you approach the conditions requiring it, and be able to do so without abruptly pulling in front of other traffic. And, of course only take the lane in urban traffic and not when the other traffic is travelling at highway speeds.

When To Take The Lane

The road conditions when I take the lane include:

● when the bike lane abruptly ends, which I interpret as the traffic engineer's way of telling me that there is not enough room alongside traffic and that I should take the lane,

● when the roadway alongside traffic is too dangerous to ride in due to pot holes or debris in the lane,

● in constructon or detour zones with lanes that are too narrow to ride alongside traffic

● alongside parked cars when simply staying out one metre risks getting forced into the dooring zone by passing motorists,

● and when the lane is simply too narrow to ride safely alongside traffic.

The bottom line on when to take the lane is when you believe that you cannot ride safely alongside traffic and that it is safe to take the lane. As the City of Ottawa states “never compromise your safety for the convenience of a motorist”.

The Teachers Dilemma

Nobody wants to give in to a bully. Indeed teachers teach students not to give in to bullies and teachers are expected to be role models and teach by example.

So the teachers, when the bully took away their collective bargaining rights with draconian legislation that took away their right to strike, used the only legal avenue they had to fight back against the bully and refused voluntary activities.

They knew the government had pushed them into a corner so that their only legal way of fighting back would impact students and keep them from doing things they loved to do. I am sure they were looking individually and collectively for a way to bring things back to normal for their students while still taking a stand against the bully government.

When they found another way to make a last stand against the government with minimal impact on students, Dalton McGuinty said no that is illegal, the only protests we will allow you to undertake are ones that harm your students.

So what next.

Teachers Political Protest Not a Strike and Not Illegal

First of all it is not a strike because it is not part of the collective bargaining process because with a government imposed contract, imposed under a draconian law whose constitutionality is under challenge, there is no collective bargaining process. Secondly the political protest is aimed at the government as policy maker and legislator, not as employer.

It is not illegal because political protests are not illegal in Canada, even if Stephen Harper and Dalton McGuinty wish they were.

Not that the teachers are completely free of consequences. For one they will not be paid for the day, and secondly their contract provisions may provide for discipline for absences not approved by the employer. But any such action will be subject to the grievance and appeal provisions of their contracts. That being said the usual discipline by employers for such absences is suspension from work without pay. So theoretically the school boards could force the teachers to take time off work without pay as punishment for taking time off work without pay. Sort of like suspending students for truancy.

The biggest irony, or perhaps more appropriately described as hypocrisy, is that Dalton McGuinty has his knickers in a knot over teachers taking a day off without pay to protest a process that has imposed a contract on them that requires them to take days off without pay.

Cycling and Mountain Biking Season in Review

I know it's not over yet, and with the winter bike it is never over, but I feel it's been a great season so far and now is as good a time as ever to put my thoughts down in print.

The time will come soon enough when the trails are no longer rideable and the salt is being dumped on the roads and paths, that I will have to bring out the winter bike. Last year my last mountain bike ride was on November 11th in the South March Highlands and my last hybrid ride on November 22nd, my first winter bike ride was a week later on November 29.

Last years total was 3175 km, 475 on the MTB and 2700 on the hybrid and winter bike from January to December. So far this year, since January, I have done 2630 km, 930 on the MTB, 1410 on the hybrid and 290 on the winter bike.

Will I actually beat those numbers this year. In a sense, I probably already have when you consider that I have almost doubled the distance on the MTB which is considerably more intense riding than hybrid riding. Of course, last year I was off the MTB for 9 weeks and off both bikes for 6 weeks, after the incident (broken arm).

But I am hoping, considering how dry the trails have been this year and still seem to be, to see an extended season before the fall rainfall and slow drying effect of the fall weather come into play.

The season started well with putting the winter bike away at the beginning of April and about a month of hybrid riding to prepare for the CN Cycle for CHEO. I really enjoyed the improved route this year, even if there was more climbing. They certainly improved the way they handled the route across the downtown core. Unfortunately the organized mountain biking participation has been steadily declining since we had 5 teams raising $15,000 at the peak of MTB Kanata. I may simply ride independently next year.

My first MTB ride this season, on the GFR trails and Trillium Woods Trail, was the day before the first OMBA South March Highlands group ride on May 12. After missing most of the SMH rides last year due to the incident I got off to a good start this year, enjoying the Thursday night rides up until they became night rides and I decided to restrict my night riding to the Greenbelt.

But perhaps what I am most pleased about this season has been the enthusiastic participation in the Tuesday Night Greenbelt Rides, and no broken bones yet. We have a great regular group of riders, sometimes joined by others, that enjoy the casual pace of just tooling around the flowy Greenbelt trails, with some technical sections thrown in for added fun. I finally got my new batteries for my Magicshine lights, which I had hardly used before. What an improvement over my old NiteHawk lights, for the same (aprox $100) price. It is a real joy to ride with these and I am really finding the continuing night riding to be a great experience.

The Greenbelt rides have also led me to find a new riding buddy, that shares my local trails and rides at about my same pace and technical ability, so riding with him has been great fun. I have to get him to expand his riding preferences though - get him out to SMH and into distance riding the on paths and roads.


I'm going to have to say, what some in OMBA might consider to be blasphemy, but I also prefer the Greenbelt to SMH for sheer enjoyment, probably because I can ride to the trails from my front door.

I believe I have only been to one OMBA SMH trail day this year but I have spent some time working on the Greenbelt trails clearing dead-fall. What a season it has been in both SMH and the Greenbelt for storms bring trees down over the trails. I have plans for early next season to get into Middle Earth on foot and clear out what is certain to be a lot of dead-fall in there and to do some discreet trail work near Old Quarry to connect up two sections of trails that are calling out to be connected and clear another section of trail that is difficult to follow, especially at night. And then some new trails to take the Tuesday Night group out on.

A report on riding would not be complete without talking about my Richard's GPS Trail Maps project to map all the western Greenbelt trails as well as other trails. I never did get back to mapping the Bruce Pit Trails, as planned this summer, as I got sidetracked into unplanned mapping at SMH in response to the clear-cut of the Beaver Pond Forest trails and the impending development of the old Kanata Lakes Trails. I also was made aware of a neat little trail system by Lytle Park that has been added to the collection.

In regards to the GPS Maps project, about a year ago I was contacted by the people who produce the Backroad Mapbooks who wanted to use my trail maps in a new GPS map product for Garmin GPS units. The end result of that was that I agreed to let them use the GPS data with no conditions and they graciously provided me with a free copy of their Ontario GPS map product. I have only used it for about a week but I have to say that I am very impressed and a full review will appear soon on "Richard's GPS Trail Maps" site.

Had a really nice ride today on a nice cool afternoon. The next two weeks are still looking pretty good, especially both Tuesdays. See you on the trails.

Thinking It Through Brings Clarity

So what is an atheist who believes in a single secular public school system supposed to think about noon hour Muslim prayers in public schools.

The answer should be simple but first let us look at the context.

In the province of Ontario there are two publicly funded school systems, one for a specific religion and one for everybody else (all other religions and non-religious persons). If one did not have an understanding of the province's constitutional history, one might assume the religion with the separate school system was the largest religious group in the province, but actually it is the second largest group that gets special treatment.

This religion has it's own school system where they are allowed to indoctrinate students in their religion and adopt policies that provide "when there is an apparent conflict between denominational rights and other rights, the board will favour the protection of the denominational rights".

While the Roman Catholic Church, and it's separate school boards, may be exempt from the Canadian Charter of Rights and Freedoms (Constitution Act, Section 29), I cannot ignore it.

Thus, as long as one religion is allowed to have it's own publicly funded school boards in which to indoctrinate students, the minimum reasonable accommodation that should be made for other religions, in the name of equality, is to allow them to use school facilities for prayer services for the convenience of students, as long as no one is compelled to attend such services.

The real solution, of course, is a constitutional amendment to remove discriminatory rights given to one religion and provide for one secular public school system in Ontario, as has been done in other provinces, including Quebec.

South March Highlands - An Open Letter

I am writing to you because we have a short window of opportunity to save much of what is arguably the most important area of environmental importance and cultural heritage within the City of Ottawa. While the South March Highlands is well known for its environmental significance, as home to a great number of species of animal and plant life, many of them endangered, recent research has also discovered that it may be just as important a site of archaeological significance, particularly in relation to our country's first peoples.


The preceding map, from the 2008 Brunton report, shows the boundary of the South March Highlands. The Google Earth view shows the lands that have already been developed and the blocked in green sections indicate the lands that are owned by the City of Ottawa and protected. The rest of the lands are privately owned, and though some are zoned Environment Protection history has taught us that all the privately owned land is at risk of being developed and at risk of environmental and archaeological destruction.

It is not the purpose of this letter to document why the South March Highlands should be saved or to reiterate the broad public support within the Ottawa area and all over Canada for saving these precious lands. That has already been well done and you have likely already seen or received such documentation. I do not wish to repeat all of that here but I will be attaching a document that provides a quick and easy overview of the significance of the South March Highlands. I will also provide links at the end of this submission to further resources on the South March Highlands.

I am writing to all of you together because saving what has not yet been developed in the South March Highlands is going to take political will at all levels of government. The City of Ottawa and the National Capital Commission will be key players, but the province and federal government will also have important roles, especially in regards to funding. This land is important and precious to all residents of Ontario and all citizens of Canada.


Time is of the essence as development plans are already underway for an important section of these lands, known as the Beaver Pond Forest, and the developer is waiting for the first opportunity to clear cut the lands, even as many questions regarding the developers fulfilment of development conditions are unanswered and the legitimacy of the environmental assessment processes followed are uncertain.

The only long term solution to save these lands for posterity is to bring them under public ownership. Fortunately, I understand that the National Capital Commission, during it's Greenbelt Master Plan Review, is considering adding the South March Highlands to the Greenbelt. There is where the federal government needs to step in to assure the NCC that the funds will be available to purchase or expropriate the remaining undeveloped privately held lands in the South March Highlands. This is an imperative part of the solution.

The NCC must also expedite this part of the Greenbelt review process so that as much land as possible can be acquired. The longer the wait the more opportunity there is to "develop the lands", that is to clear-cut the forest, blast the geology and otherwise destroy the land.

Ideally, in the meantime there would be a moratorium on all development in the South March Highlands, supported and legislated by the municipal, provincial and federal governments.

Until such a moratorium can be put in place the City of Ottawa, which controls the development process, must do all that it can to prevent further development from proceeding.

The most important thing that the City of Ottawa can do, is to do what it should be doing anyway, which is to ensure that all environmental measures, including wetland and watershed provisions, and cultural heritage/archeological processes are fully and properly undertaken and that all approvals are properly in place before any development is allowed to take place.

The City must also ensure that all developers have complied with all requirements of subdivision agreements and other approvals before allowing a single tree to be cut, rock to be blasted or land to be bulldozed.

The City can also act to assure the public of their good faith by offering to purchase or expropriate the lands under imminent threat of development. There is where the provincial government needs to step in to assure the City of Ottawa that the funds will be available to purchase or expropriate these threatened lands. This is also an imperative part of the solution.

Of course the first thing the City of Ottawa needs to do is to provide an opportunity for City Councillors to get a firm understanding of all the issues surrounding the South March Highlands, particularly new City Councillors. The best way to do that would be to have the matter referred to committee where public input can be provided, before allowing any further development measures to take place on any South March Highlands lands.

If all levels of government work together and show leadership and political will we can save the South March Highlands. The people that you represent expect no less.

Municipal Elections Suck

So why do municipal elections suck.

Because the way the system works now all too often the least preferred candidate wins rather than the most preferred candidate.

This results from the fact that there are often a large number of candidates, many of whom may share a similar philosophy and similar policies and who appeal to the same group of voters. For simplicity sake lets divide the candidates (and voters) into alphas and betas, for want of better terms.

Various scenarios can come into play here but for demonstration purposes lets look at a simple one. Let us say there are three alpha candidates that share 60% of the vote roughly and one beta candidate with 40% of the vote. Let us assume, reasonably, that the beta candidate is the last choice of almost all of the alpha voters. And let us assume, also reasonably, that while all the alpha voters may have individual preferences all the alpha candidates are acceptable to almost all of the alpha voters.

Under our present electoral system the beta candidate, the last choice of the majority of voters and the one acceptable to only a minority of voters would get elected. Similar situations can happen with different numbers of candidates and different breakdowns with either beta or alpha candidates benefiting from the flaw in the system.

Another effect of this of course is that people realize this is happening and "strategic voting" comes into play and voters attempt to avoid this by voting for their second or third choices instead of their first, depending on who the media says has the best chance of winning. Such a situation deprives voters of the ability to vote for their first choice and gives the media an inordinate (and undemocratic) amount of power in choosing who gets elected.

There is an alternative - system that allows voters to vote for their first choice amongst acceptable candidates and not vote for unacceptable candidates. Instead of voting for one candidate you would rank the candidates in order of preference, ranking as many candidates as you wish and avoiding ranking unacceptable candidates if you do not wish to. The votes would be tabulated electronically dropping the bottom candidates from the list and redistributing their votes to the voters next choice until a candidate receives over 50% of the vote.

Under this system the least preferred candidate would never be elected and the elected candidate would always be acceptable to the majority of voters.

This would allow voters to vote for their first choice knowing that if their first choice was not amongst the top vote recipients their vote would be transferred to their second choice and not become a de facto vote for the candidate they least liked. Strategic voting would be eliminated and all candidates would know how much real first ballot support they had and candidates would not be penalized because the media tells everyone they do not have a chance.

This type of system, of course, would not just work in municipal elections. Indeed, this is the type of system that the United Kingdom is going to hold a referendum on.

Using such a system in Ontario municipal elections would be an excellent place for us to start. While it is likely too late to introduce in this years election it may very well not be too late to add a question to the ballot in the November election to find out what voters think of the system.

While this may seem like a my most radical proposal yet it follows naturally from what I have already written:

Getting people out into the environment, onto the lakes and rivers and into the forests builds healthy lifestyles, and healthy lifestyles improve our health and reduces our health care costs. This is important at a time when obesity, and childhood obesity in particular, is at epidemic levels. We need natural spaces and trails to teach our children the benefits and enjoyment that can be had in the great outdoors. The National Capital Region is fortunate that we have a population that celebrates healthy lifestyles and rises up to challenge those that want to take our natural spaces and trails away from us. Allowing mountain biking on the trails is one more way to encourage people to get out and enjoy nature.

Young people need the type of challenges the outdoors can provide as an alternative to spending their time in a sedentary lifestyle centred on electronic devices, or other even worse, but seemingly exciting, activities like gangs and drugs. Youth can be attracted to these things by the very risks we want to protect them from. Outdoors activities such as rock climbing and mountain biking can provide exciting healthy risks that build character and a healthy body.

Mountain biking is the perfect activity to get young people active and out in the environment. It combines man and machine (or boy and machine) with a sense of adventure, all in a natural setting. The Greenbelt trails are the ideal location as many are closes to neighbourhoods and they have a wide variety of levels of riding difficulty and challenge.
The Old Quarry are trails are particularly suited for young riders just starting out in mountain biking because they provide a wide range of difficulty from easy flat gravel trails to intermediate level rooty and rocky trails.

A beginner level mountain bike skills park adjacent to these trails would be ideal for this location that is close to communities with young families and schools, as well as having it's own parking and close proximity to additional parking and facilities at the Hazeldean Mall.

The proposed location is off to the side of the trails and separated from roadways and traffic by bush.

Why A Youth Mountain Bike Skills Park

There are two documented changes in young people's lives from when I grew up to today. They are a decreased level of physical activity and a disconnect from nature. Part of this stems from parents fear of letting their children play and wander outside alone and part of it stems from competition for their attention from technological devices from television to video games to the Internet.

We need to excite kids to get them to choose real outdoor physical activity over indoor virtual pursuits. Mountain biking is seen as an exciting "extreme" sport that can provide that excitement, yet when done with proper training at each individuals ability level it can be as safe as any other sporting activity.

A skills park can provide the setting and resources to teach young people how to handle their bikes safely and how to safely navigate technical mountain bike trails, as well as how to judge what they are capable of safely attempting on their bikes.

As well as including natural and man-made features to learn and practice their skills on, the park could also include educational displays on safe and responsible riding and respect for the trails, the environment and other trail users.

I believe this location is an excellent one for a beginner level mountain biking skills park as young riders can practice the skills they learn in the park on the adjacent trails that provide a wide range of trails of varying levels of technical difficulty.
